TERMS AND CONDITIONS

These TERMS AND CONDITIONS are applicable to the provision and access of internet based services provided by ARC Net Ltd. If you are accessing these services you are advised to carefully study these TERMS AND CONDITIONS.

ARC IP addresses are any range or network of IP addresses assigned to or directly employed by ARC Net Ltd and associates in the provision of ARC services.

ARC services, for example web, email, dns, are those IP based services provided by ARC Net Ltd and associates.

Whilst material from ARC web sites may be made publicly available it is not free of copyright or intellectual property rights.

Under no circumstances may you use ARC web sites for the development or production of content or for reprinting or rebroadcast, reproduction or redistribution in any other medium (amongst other things that means radio, television and print) without the express written permission of ARC Net Ltd.

You access any ARC service entirely at your own risk. The ARC does not accept responsibility or liability for any offence, loss or consequential damage caused by accessing the content of any ARC service or any inaccuracies errors or omissions in the content or provision of any ARC service.

Cookies may be used by ARC web sites and by accessing that web site you agree to the use of such technologies.

Technologies or services provided either by the ARC or third parties may be used by ARC web sites and other ARC services and by accessing any ARC web site or service you agree to the use of such technologies or services. For example these may include services such as Google Fonts or blacklists of IP addresses or third party analytic services.

Abuse of any ARC service or IP address by persistant and repeated pings, traceroutes, denial of service attempts, spamming, service, content, intrusion, vulnerability, discovery scans and monitoring, penetration testing, hacking, break-in attempts, service high-jacking or poisoning or any other similar traffic to any ARC IP address or service using any internet protocol will be deemed as wilful and malicious access and is strictly prohibited traffic and thus in contravention of these TERMS AND CONDITIONS.

All email addresses associated with domains that have mail services provided by ARC may not be harvested by any third party or be passed to any third party for whatever reason without the full and explicite agreement of the account holder of the email address. Any such non-agreed use will be in contravention of these TERMS AND CONDITIONS.

Sending unsolicited email also known as spam to any ARC mail service or email address is strictly prohibited traffic and thus in contravention of these TERMS AND CONDITIONS.

Without restriction as to the time and date of any access or limitation on seeking further redress we reserve the right to use any and all means necessary to locate examine and identify the source of any traffic sent to any ARC IP address. This may include but not exclusively port and service scanning, tracing and other forms of investigation conducted by us. By sending any traffic to any ARC IP address you hereby agree to such measures and you accept full liability for the consequences. The ARC shall not be held liable for any damage or disruption that may occure as a consequence of such investigations by us.

Without restriction as to the time and date of any access or limitation on seeking further redress we reserve the right to charge you if you fail to abide by these TERMS AND CONDITIONS. In particular this includes although not exclusively prohibited traffic. The current chargeable rate for such traffic is One Pound Sterling per IP packet received using whatever protocol sent to any ARC IP address. Penalties on unpaid invoices will be chargeable, including all interest, tax, bank, administrative, court costs and legal fees.

We may raise invoices at any time as deemed appropriate by us.

Unless otherwise stated we expect invoices to be paid immediately.

We reserve the right to factor any invoice raised by us.

Late payment interest and penalties are charged for including statutory compensation for each late invoice in addition to interest charges on all ongoing and outstanding invoices at the compound rate of 8% above base lending rates.

We reserve the right to block or filter any IP protocol or IP address or network and to use whatever means necessary to discover the source and originator of any traffic received or directed to or from any ARC IP address or service.

We reserve the right to forward any content or information we obtain on any traffic to or from ARC IP addresses to any third party and may as we see fit also make all or part of the content of such traffic publicly available. Without limitation such information as we gather may be used for the purposes of constructing and maintaining blacklists, filtering, monitoring, security and reputation services. We shall not be held liable for any consequential injury, loss or damages that may result from the use of such information by us or any third party.

You should be aware that all traffic to or from ARC IP addresses is logged and that traffic may be monitored by us.

When contacting us you must provide your valid email address, your full real name and any business or institutional name and address. If you are acting on behalf of a third party you must also provide their complete contact details including company or institutional names and relevant full individuals names, their email addresses and business or institutional addresses.

We reserve the right to change or modify these TERMS AND CONDITIONS at any time.

By accessing or sending IP traffic to any ARC IP address or service you are accepting and are bound by these TERMS AND CONDITIONS.

These TERMS AND CONDITIONS are subject to English and where appropriate European law.
